ScanMyPhotos Terms of Service

Thanks for choosing ScanMyPhotos.com! These Terms of Service explain how everything works when you use our photo scanning and digitizing services. They help protect both you and us, and using our site or placing an order means you agree to what’s written here. Your work is processed at our Irvine, CA HQ and never sent oversees (what's up with others doing that anyway?).

1. What This Covers

These Terms apply to all services provided by ScanMyPhotos. That includes anything related to scanning, restoring, digitizing, or handling your photos, film, slides, videos, or digital files—whether sent by mail or uploaded.

2. What You’re Sending

You may send us standard photos, negatives, slides, film, videotapes, certain other media like reels of 8mm and 16mm home movie film. Together, we call these your Materials.

By sending your Materials, you agree that:

  • You own them or have permission from the rightful owner to have them scanned or copied.
  • You give us permission to handle, digitize, and store them as part of fulfilling your order.
  • These are yours and you own them.
3. Copyright Responsibility

We take copyright seriously and so should you. It’s your responsibility to make sure everything you send can legally be duplicated.

Please only send Materials that:

  • You created yourself
    or
  • You have written permission to digitize/duplicate (such as a release from the photographer or rights holder)

If we receive anything that appears to be or is clearly copyrighted without permission (such as studio photos or marked images), we may decline the order. You also agree to indemnify and protect ScanMyPhotos from any claims related to copyright infringement.

4. What We Do (and Don’t) Guarantee

We treat your memories with care, and we’ve preserved a billion photos since 1990. But we want to be clear:

  • Our high-speed scanning service is designed for personal photo use, and museum-level archiving.
  • If your originals are blurry, faded, overexposed, or damaged, your scans may reflect those imperfections.
  • While we may adjust and crop images for the best possible results, we do not guarantee perfection or color-correct every image manually.

All services are provided “as is”, with no warranties, either express or implied—including quality, fitness for a particular purpose, or merchantability.

5. All Sales Are Final (Here’s Why)

Because every order is custom, all sales are final. That means:

  • No refunds
  • No cancellations
  • No returns

Once we receive your Materials, our team gets to work scanning, organizing, and processing your exact items. There’s no way to undo that work or restock it—it’s made just for you.

6. Shipping & Tracking

You're responsible for getting your Materials to us safely. We return them using the shipping method you choose during checkout including uploading them to your email inbox via "We Transfer' or other services.

📦 Want extra peace of mind?

We recommend including a GPS tracking device—like an Apple AirTag®, Tile®, or similar tracker—inside your box. You’ll be able to follow the entire journey from your home to our scanning HQ in Irvine, CA. We’ll return the tracker with your completed order.

ScanMyPhotos.com is not responsible for items lost, damaged, or delayed in the mail or by your chosen shipping carrier.
Any completed orders not claimed within 30 days may be discarded.

7. If Something Goes Wrong

We do everything we can to safeguard your order, but things can occasionally go wrong.

If your Materials are lost or damaged while in our care, your only remedy is store credit equal to what you paid for the affected service.

We’re not liable for emotional value, sentimental loss, or consequential damages. We also cannot compensate for anything lost or damaged in transit before it reaches us or after it leaves.

8. Privacy & Acceptable Content

We respect your privacy. Our Privacy Policy explains how we protect your personal info and scanned content. We don’t sell, share, or publish your photos — ever.

You are responsible for backing up your digital files after they’re returned to you. Unless you’ve purchased backup storage, we don’t keep a copy.

🚫 Do not send anything that violates any laws or could be considered inappropriate, dangerous, offensive, or misleading.
That includes, but isn’t limited to, anything illegal to reproduce, impersonating others, used to harass or threaten, or intended to deceive.

We reserve the right to reject or report any material we believe violates these standards.

9. Pricing & Terms Changes

We may update our prices, services, turnaround times, or terms without notice. But once your order is placed, your pricing and terms are locked in for that transaction.

10. Governing Law

These Terms are governed by the laws of the State of California. Any legal disputes will be resolved through arbitration in Orange County, California.

  • We scan your stuff carefully, but we can’t guarantee perfection. We work magic… we just can’t promise a miracle on every vintage scan.

  • If something goes wrong, store credit is the only remedy. This doesn’t apply if you simply don’t like how a scan looks — especially if the issue comes from the original photo media. We’re not liable for delays, damages, or imperfections caused by shipping carriers, age of materials, or anything outside our control. We also aren’t responsible for pricing, typos, outdated info, or unintentional errors in our advertising, promotional materials, information on the website, etc.
  • We’ve been doing this since 1990, and we’ll always do our best to help you.

Submitting any tangible or electronic media, image, data, file, card, disc, device, film, print, slide, or negative for any purpose — including digitizing, processing, printing, duplication, alteration, enlargement, storage, transmission, or any other handling to ScanMyPhotos ("The Company") constitutes an agreement by you that any damage or loss caused by The Company, its subsidiaries, or agents will not entitle you to any recovery. No warranty is entered into.

PLEASE READ CAREFULLY: YOU ARE NOT ENTITLED TO ANY DAMAGES, INCLUDING BUT NOT LIMITED TO CONSEQUENTIAL DAMAGES, FOR ANY REASON OR UNDER ANY THEORY OF LIABILITY FOR SERVICES PROVIDED BY THE COMPANY.

The Company’s services are provided “as is” and without fault. We disclaim all warranties and conditions—express, implied, or statutory—including (but not limited to) any implied warranties of merchantability, fitness for a particular purpose, accuracy, or completeness of services provided. You agree that there is always risk when shipping anything, regardless of which courier or delivery service you choose. You understand and agree not to hold The Company (ScanMyPhotos), its employees, directors, owners, or affiliates liable for any loss or damage to your order. You also understand and agree that The Company cannot and does not guarantee that your order will arrive safely. Your items may be lost or damaged while in transit or while in our possession. You agree to defend and indemnify The Company against all expenses and liabilities arising from the services requested, regardless of legal theory — including violation of law, your negligence, or our breach of these Terms.
